Privacy policy

1. Scope

This policy describes how Janover Capital LLC ("Janover Capital," "we," "us") collects, uses, shares and protects information in connection with commercialproperty.today (Commercial Property Today, the "Site"), which Janover Capital operates. It applies to this Site only. Other Janover sites and third-party sites linked from here have their own policies. By using the Site, you agree to this policy and to our Terms of use.

2. Information we collect

The financing request form (on /financing/) collects: property type, state, city (optional), loan purpose, loan amount, purchase price or value, annual net operating income (optional), the lender type you lean toward, when you need to close, your name, your role, email, phone (optional) and anything else you write about the deal.

The contact form (on /contact/) collects your name, email, phone (optional) and your message.

Both forms also send, as hidden fields: the page you sent it from; the consent sentence shown next to the button; any campaign tags in the link that brought you to the Site (utm parameters) and the referring page, which the Site keeps in your browser's session storage for that visit only; and an empty anti-spam field. We store the time the request arrived.

Rate alerts (on /rates/) collect your email address, the alert you chose, the sentence you agreed to and the time. Alert sign-ups are used only to send that alert; they are not added to marketing lists. Alert emails haven't started yet; the first will ask you to confirm, and every one will carry a one-click unsubscribe.

The dashboard and data pages ask our own server for the latest published rates. Those requests carry no personal information you typed. The embeddable rate widget sets no cookies.

Collected automatically. Our hosting provider, Cloudflare, processes standard technical data such as IP address, browser type, the pages requested and the time, to deliver the Site and protect it from abuse.

The Site runs no analytics or advertising tools.

From other sources. If you ask us to help arrange financing, we may receive information about you or your transaction from public records, lenders and transaction parties (for example appraisers or title companies).

3. How we use information

To read and reply to your request and, if you ask, evaluate and help arrange the financing you request; to communicate with you about your inquiry and our services, by phone, text and email as described in section 5; to send alerts you set; to operate, secure and improve the Site; to comply with law and legal process; to enforce our Terms; and to detect and prevent fraud and abuse. We may use aggregated or de-identified information that doesn't identify you for any lawful purpose.

4. How we share information

We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising. Requests sent through this Site go to Janover Capital. We share information only as follows:

  • Lenders and transaction parties, at your direction. If you ask us to work on your financing, we share deal and contact information with prospective lenders and parties needed to evaluate or close it (for example appraisers, title companies, environmental consultants and counsel). We don't pass your request to anyone for marketing.
  • Service providers. Cloudflare hosts the Site and the database where form submissions and alert sign-ups are stored. Our email provider delivers your request to our team.
  • Affiliates. Affiliated Janover businesses, for the purposes in this policy.
  • Professional advisors. Our lawyers, accountants and insurers, as reasonably needed.
  • Legal and safety. When we believe disclosure is required by law, subpoena or legal process, or needed to enforce our agreements or protect the rights, property or safety of Janover Capital, our clients or others.
  • Business transfers. In a merger, acquisition, financing, reorganization or sale of all or part of our business, information may transfer as a business asset.

5. Communications and your choices

If you give us contact details, we may contact you by phone, text and email about your request and our services, as the sentence beside each form says and our Terms describe. Consent isn't a condition of any service. Reply STOP to any text to opt out of texts, use the unsubscribe link in any marketing email, or contact us at (561) 559-4111 or hello@commercialproperty.today to change your preferences. We may still send non-promotional messages about an active request or transaction.

6. Cookies and similar technologies

The Site sets no cookies. It uses your browser's session storage to remember, for the current visit only, the campaign tags and referring page you arrived with, so they can travel with a form you send. Closing the tab clears it. Your browser settings can block storage and the Site still works. The Site does not respond to "Do Not Track" signals; where the law requires, we honor opt-out preference signals such as Global Privacy Control, and as noted above we don't sell or share personal information for cross-context behavioral advertising.

7. Data retention

We keep information as long as reasonably needed for the purposes in this policy, including transaction records and legal, tax, accounting and regulatory requirements, resolving disputes and enforcing agreements. Form submissions and alert sign-ups are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.

8. Security

We use commercially reasonable administrative, technical and physical safeguards. No method of transmission or storage is completely secure. Please do not send sensitive personal information (such as Social Security numbers or account credentials) through the Site's forms; if a transaction needs sensitive documents, we will arrange an appropriate channel.

9. Your privacy rights

Depending on where you live, you may have rights to know or access the personal information we hold about you, correct it, delete it, get a portable copy, or opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. Contact hello@commercialproperty.today or (561) 559-4111 with your name, contact details and the request. We may need to verify your identity, and we won't discriminate against you for exercising a right. Authorized agents may submit requests with proof of authorization.

10. Children

The Site is a commercial real estate site for adults. It is not directed to, and we do not knowingly collect personal information from, anyone under 18. If you believe a minor has sent us information, contact us and we will delete it.

11. Users outside the United States

The Site is operated from and intended for users in the United States. If you use it from elsewhere, your information will be transferred to, stored and processed in the United States, where privacy laws may differ.

12. Third-party links

Every figure on the Site links to its publisher: the U.S. Treasury, the Federal Reserve Board, the Federal Reserve Bank of New York, the FDIC, Freddie Mac, the SEC (EDGAR), KBRA, Green Street, the Mortgage Bankers Association and CBRE. This policy doesn't apply to those sites, and we aren't responsible for their privacy practices.

13. Changes to this policy

We may update this policy. The revised version will be posted here with a new effective date. Continued use of the Site after posting means you accept it.
